Medical malpractice lawsuits are very different than car accident cases and slip and fall cases. It is very important that you call a lawyer right away if you think you’ve been the victim, or a loved one has been the victim of medical malpractice. The law is very different and there’s specifics in the statute and in the law in general that you have to follow as an attorney. For example; a lawyer can’t just bring a lawsuit in court if the lawyer and the client believe there’s been medical malpractice. There’s a specific process and notice that has to be followed and given to the doctor, which includes an affidavit, a notice of intent to initiate litigation, and other very specific, and very detailed things in the statute. Now if that statute’s not followed then your case gets thrown out of court right away. So it’s very important that you call a medical malpractice lawyer right away, in fact, there is a statute of limitation, it is shorter in medical malpractice cases. You can only bring a case two years from the date you knew or should have known of the medical malpractice incident, and in no case, more than four years after that actual incident itself. That’s a very complicated little legal principle that I just mentioned that’s part of Florida Statute.
